1. Agreement

These Terms of Service ("Terms") govern your use of the LifeWishGuardian website and mobile application (together, the "Service"). The Service is operated by LifeWishGuardian LLC ("LifeWishGuardian," "we," "us," or "our"). By accessing the website or creating an account or using the app, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

LifeWishGuardian lets you record and store your healthcare wishes, including videos you record and documents you upload, and share that content with family members and other people you choose. The website describes the Service. Features may change over time. An Android version of the app is not available yet.

3. Not medical advice

LifeWishGuardian is not a healthcare provider, medical device, or emergency service, and it does not provide medical advice, diagnosis, or treatment. Videos, documents, and other content in the Service are your own personal communications. They are not a substitute for advice from a qualified clinician. If you think you have a medical emergency, contact emergency services.

4. Not legal advice, and not a substitute for a legal advance directive

LifeWishGuardian does not provide legal advice. Content you record or store in the Service is not a substitute for a legal advance directive, living will, healthcare power of attorney, or any other document that must meet formal legal requirements. Laws differ by location and may require specific forms, signatures, witnesses, or notarization. A healthcare provider, court, or family member may not be required to follow content stored in the Service. You should consult a qualified attorney about whether your wishes are legally effective where you live.

5. Who may use the Service

The Service is intended for adults recording their own healthcare wishes. It is not directed to children under 13. You are responsible for your account and for keeping your sign-in credentials confidential. If you invite a loved one to record their own wishes, those wishes must be their own: they record in their own words and decide what to share. You may not submit healthcare wishes for another person as if they were yours.

6. Your videos and documents

You keep ownership of the videos, documents, and other content you submit. You grant LifeWishGuardian a limited license to host, store, back up, transmit, and display that content only as needed to operate the Service and to share it with the people you authorize. You are responsible for the content you submit and for having the rights needed to store it and to share it with the people you choose.

7. Sharing with family and others

Your content is private unless you share it. You decide which family members or other people can receive or view your videos and documents, and you can change that access as the Service allows. You are responsible for the invitations you send and for reviewing who can see sensitive information. Do not share another person's content except as they have allowed. People you invite should use shared content only for the purpose you intend.

8. Acceptable use

You agree not to misuse the Service. You will not break the law or violate someone else's rights; upload content you do not have the right to store or share; attempt to access an account, video, or document without authorization; interfere with the Service; or use the Service to impersonate another person.

9. Privacy

Our Privacy Policy describes how personal information is handled. These Terms do not change that policy.

10. Availability

The Service is provided as available. We may change, suspend, or stop features. We do not promise that the Service will be uninterrupted, error-free, or available on every device or app store.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." LifeWishGuardian disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that content you store will be accepted by any healthcare provider, insurer, or court, or that storage or transmission will be error-free.

12. Limitation of liability

To the fullest extent permitted by law, LifeWishGuardian LLC and its members, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of your use of the Service. Our total liability for a claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim, or one hundred U.S. dollars if you paid nothing. Some places do not allow certain limitations, so parts of this section may not apply to you.

13. Stopping use

You may stop using the Service at any time. You may request deletion of your account through the contact form. We may suspend or close access if you violate these Terms or if we need to do so to protect the Service or other people.

14. Changes to these Terms

We may update these Terms by posting the new version on this page and changing the "Last updated" date. Continued use of the Service after an update means you accept the updated Terms.
